Executor

When a person dies after writing a valid will, then the person who is in charge of fulfilling the dead person’s wishes under the valid will is called an Executor.

A will must state who should put into effect the wishes of the deceased as stated in the will.

Duties of the Executor:

  • Upon getting Grant of Probate from Court, the Executor may then begin carrying out the provisions made in the will, including making an inventory of property, distributing property, and paying the deceased’s debts.
  • Within six months of receiving the Grant of Probate, the Executor must file a true list of the deceased’s property with the court.
  • Within one year of receiving the Grant of Probate, the Executor must file another list describing how the property was distributed.
  • Once the will is carried out, the Executor must file a final report with the court.

Powers of Executor can be revoked by Court:

If the Executor does not manage the deceased’s property properly according to the will, other beneficiaries of the will may seek redress from the Executor in court.
